On this question I need to know and I am sure someone can enlighten me...?

If a player is waived outright or cut; does his salary go towards the cap limit?

If waived and assigned to the minors, the remaining salary does not count.

If waived and claimed, the team is responsibity for half the salary.

If cut, the team is responsible for 100% of the salary.

This isn't exactly accurate.

If the player is waived and assigned to the minors, the salary does not count against the cap.

If the player is waived/cut and not assigned to the minors, the salary still counts against the cap.

If the player is claimed on waivers by another team, the new team is responsible for the entire salary.

Half of the player's salary is subject to the team's cap only when a player had previously cleared waivers and was assigned to the minors and then the team tries to recall the player from the minors and is claimed by another team on waivers. This is the case when a player earns more than $75,000 in the minors. Players earning less than $75k in the minors are not subject to recall waivers.

I don't have a link, but this is correct.

That is unless the player in question has a two-way contract in which case he can be moved back and forth without worrying about waivers.

They won't waive Malakov. Even if the salary doesn't count against the cap, they would still have to pay the guy. The team's owner doesn't have an unlimited supply of money, he's not waiving the 5th highest player on the team.

how would we know that some team picks him up and we still pay money

Traded to the Flyers who came 1 game away from the SC finals with him as arguably their #2 defenseman.

This is absurd. If the Devils can improve by dumping a player they will waive him in the blink of an eye. They would no longer have Malakhov as a liability, they would be under the cap and they would be able to keep everyone else. They would be a better team. They would take the hit if they could not trade him. I do not think they will be able to. Atleast I could not imagine who would want him. When they end up adjusting the roster for Elias it will Malakhov will not be owed $3.6 million. It might be as much as half of that.

Next year he would have to be paid as well but I am sure they would take the write off with the future new arena profit if it meant getting some cap space to add possible assets to the team.
